DMCA Policy

"The Office Mexico" respects the intellectual property rights of others and is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for copyright holders to request the removal of infringing content and for users to submit counter-notifications if their content has been wrongfully removed on our platform.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on "The Office Mexico" website or services, please notify us by providing our Copyright Agent with the following information in writing (see 17 U.S.C. ยง 512(c)(3) for further detail):

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit "The Office Mexico" to locate the material.
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid DMCA notice, "The Office Mexico" will promptly investigate and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to submit a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA. Your counter-notification must be in writing and include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which "The Office Mexico" may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, "The Office Mexico" will forward it to the party who submitted the original DMCA notice. If the copyright owner does not file an action seeking a court order against the content provider within 10-14 business days, "The Office Mexico" may, at its sole discretion, replace or re-enable access to the removed material.
